Welcome to Nova Market & Café ("Nova," "we," "us," or "our"). By visiting our premises, placing an order, using our services, or accessing our website, you agree to be bound by the following Terms & Conditions. If you do not agree, please do not use our services.

1. Business Information

Governing Law: These Terms are governed by the laws of the State of Tennessee.

2. Services Offered

Nova Market & Café provides:

  • In-store grocery and dry goods sales

  • Café dining (dine-in and takeout)

  • Online ordering through third-party platforms (e.g., DoorDash)

  • Catering services

  • Special sourcing of kosher and Israeli products upon request

We reserve the right to modify, suspend, or discontinue any service at any time.

3. Food Consumption, Allergies & Assumption of Risk

  • Customers must disclose all food allergies or dietary restrictions prior to ordering.

  • While we take precautions, cross-contamination may occur.

  • All food is consumed at the customer’s own risk.

  • Nova Market & Café assumes no responsibility for reactions caused by:

    • Undisclosed allergies

    • Personal health conditions

  • We are not responsible for improper storage, reheating, or handling of food after it leaves our control.

  • Prepared food sales are final and non-refundable once food leaves the premises.

4. Kosher Supervision & Religious Disclaimer

  • Our kitchen operates under the rabbinic supervision of Rabbi Taichtel, Chabad of Nashville.

  • Kitchen designation: Dairy / Pareve.

  • Kosher status applies only to items prepared on-site.

  • Packaged goods rely on the manufacturer’s kosher certification.

  • Kosher standards vary by individual; customers are responsible for determining suitability for their personal religious observance.

  • Nova Market & Café assumes no responsibility if a product meets kosher certification but does not meet a customer’s personal standards.

5. Online Orders & Third-Party Delivery (DoorDash)

  • Third-party platforms (e.g., DoorDash) are independent entities not controlled by Nova Market & Café.

  • Responsibility for orders ends once they leave our premises.

  • We are not responsible for:

    • Late deliveries

    • Missing or altered items during delivery

  • Delivery complaints and refunds must be handled directly through the delivery platform.

  • Third-party orders are subject to the platform’s own terms and refund policies.

6. Catering Services

  • Catering orders for 10 or more people require at least 48 hours’ notice.

  • A 50% deposit is required to confirm catering orders.

  • Deposits are refundable up to 24 hours before the scheduled time.

  • Exception: Deposits may be non-refundable if special items were ordered at the client’s request.

  • Clients may request changes; approval is solely at Nova Market & Café’s discretion.

  • We reserve the right to decline or cancel catering orders due to availability, staffing, supply issues, or unforeseen circumstances.

  • Setup and cleanup are handled case-by-case.

  • Leftover food becomes the client’s responsibility once delivered or picked up.

  • Liability is limited for event delays, guest reactions (including allergies), and venue-related issues.

7. Special Orders & Product Sourcing

  • Special orders and sourced items are handled case-by-case.

  • Prepayment and refund eligibility may be required or denied depending on the item.

  • Delivery and arrival dates are estimates, not guarantees.

  • We reserve the right to cancel sourcing requests due to supplier availability or changing circumstances.

  • Customers are responsible for confirming sourced items meet their personal kosher standards.

8. Pricing, Payments & Refunds

  • Prices are subject to change without notice.

  • We reserve the right to correct pricing or listing errors.

  • Accepted payments include credit/debit cards, cash, and digital wallets.

  • Refunds are issued at our discretion, where permitted by law.

  • Grocery and packaged goods are final sale, except where required by law.

9. Website Use & Intellectual Property

  • All website content, branding, logos, menus, text, and images are the property of Nova Market & Café.

  • Unauthorized copying, reproduction, or use is prohibited.

  • We may update or remove website content at any time.

  • Misuse of the website (fraud, scraping, abuse, unlawful activity) is prohibited.

10. Limitation of Liability & Indemnification

  • Nova Market & Café’s total liability is limited to the amount paid by the customer.

  • We disclaim all indirect, incidental, or consequential damages.

  • Customers agree to indemnify and hold Nova Market & Café harmless from claims related to:

    • Allergies or health reactions

    • Improper food handling

    • Misuse of products

    • Third-party delivery services

11. Updates to Terms

We may update these Terms at any time. Continued use of our services constitutes acceptance of the updated Terms.
